Deliveroo Referral Code

Deliveroo's offer is a chance at $50, which is a different thing from $50. And the more consequential fact about the company was decided by the UK Supreme Court in November 2023.

Two things need separating on this page, and the second is far more important than the first.

The offer is a prize draw. "A chance to earn a $50 reward" is not a $50 reward. A chance is worth its probability multiplied by its value, and neither figure is published — which means, for any individual referrer, the expected value is close to zero. This site's standing position, applied to FabHotels' Goa trip elsewhere in this export, is that prize draws in referral offers are marketing rather than compensation. Delete the draw, evaluate whatever remains, and treat a win as a bonus. If the draw is what makes an offer persuasive, the offer is weaker than it looks.

The substantive fact about Deliveroo is a Supreme Court judgment, and it is worth stating precisely because it is widely misreported.

On 21 November 2023, in IWGB v CAC [2023] UKSC 43, the UK Supreme Court held that Deliveroo riders represented by the IWGB union were not in an "employment relationship" for the purposes of Article 11 of the European Convention on Human Rights, and therefore had no right to compulsory collective bargaining. What proved decisive was the substitution clause: under the rider contract, the power to appoint a substitute to do the work was, in the Court's assessment, virtually unfettered. That was reinforced by riders being free to reject offers of work, to make themselves unavailable, and to work for competitors.

The contrast that makes this legible is Uber. In Uber BV v Aslam [2021] UKSC 5, decided on 19 February 2021, seven justices unanimously held that Uber drivers are workers — and, further, that they are working whenever logged into the app and available to accept a trip, not merely while carrying a passenger. The Court pointed to Uber fixing driver pay with no driver influence, setting passenger fares, and dictating contract terms. Crucially, Uber drivers could not send a substitute.

So the hinge between the two cases is the right of substitution, and that is the single most useful thing to understand about UK gig employment status. It is not decided by how the work feels, how much control is exercised in practice, or how dependent the individual is on the income. It turns substantially on whether the contract genuinely permits someone else to do the job in your place — and a right that is real rather than theoretical can be decisive.

Why this belongs on a referral page. This site has repeatedly found listings that describe a platform's rider or courier programme while presenting it as a customer referral — the same confusion documented on Blinkit, Borzo and Shopsy. Anyone arriving here looking to earn money by delivering rather than by ordering is looking at a different proposition entirely, and the employment status of that proposition was decided by the highest court in the UK. On the customer offer itself: the standard cautions for this category apply. Percentage discounts are usually capped, in which case the advertised rate is true only at one basket size. Delivery fees, service fees and packaging charges are typically applied outside the discount, so the only honest comparison is the final payable amount with and without the code. And multi-order welcome offers are retention mechanics — worth taking, worth re-evaluating when they end.
